Assumption of Risk and Waiver of Liability

By participating in Wow Factor Sports programs, lessons, camps, training sessions, or any related activities, you acknowledge and agree to the following terms:

1. Inherent Risks

Sports activities, including training, lessons, practices, and games, involve inherent risks. These risks include, but are not limited to:

  • Being struck by balls, bats, or equipment
  • Collisions with other players, coaches, or objects
  • Sprains, fractures, concussions, and other physical injuries
  • Risks associated with outdoor conditions such as heat, cold, or uneven playing surfaces

You acknowledge that serious injury or death may occur while participating in these activities.

2. Voluntary Participation

You (or your child) are voluntarily participating in Wow Factor Sports activities and assume all risks, known or unknown, associated with participation. You agree that participation is entirely at your own risk.

3. Waiver of Liability

In consideration of participation in Wow Factor Sports programs, you agree to waive, release, and discharge Wow Factor Sports, its owners, coaches, staff, affiliates, and volunteers from any and all claims, liabilities, or damages arising from participation. This waiver includes, but is not limited to, claims for:

  • Personal injury
  • Property damage
  • Illness, including exposure to communicable diseases (e.g., COVID-19) Any other loss or damage, whether caused by negligence or otherwise.

You grant Wow Factor Sports permission to use photographs and videos taken during activities for promotional purposes, including but not limited to websites, social media, and printed materials.

4. Medical Treatment Authorization

You authorize Wow Factor Sports to seek emergency medical treatment on behalf of you or your child if necessary. You accept full responsibility for all medical expenses incurred.

5. Responsibility for Safety

You agree to ensure that you (or your child) use appropriate protective equipment—such as helmets, gloves, and athletic footwear—as instructed by Wow Factor Sports staff. You further agree to follow all safety rules and instructions.

6. Media Release

You grant Wow Factor Sports permission to use photographs and videos taken during activities for promotional purposes, including but not limited to websites, social media, and printed materials.

7. Acknowledgment of Understanding

By participating in Wow Factor Sports programs, you confirm that you have read, understood, and agreed to this waiver of liability. You understand that you are giving up certain legal rights and assume all risks associated with participation.

Hold Harmless, Waiver and release of liability agreement

1. Acknowledgment of Risk

The Participant understands that activities at The Facility LLC involve inherent risks, including physical injury, illness, property damage, or other unforeseen hazards, and voluntarily chooses to participate with full knowledge of these risks.

2. Waiver & Release of Liability

The Participant releases and holds harmless The Facility LLC, its owners, employees, coaches, volunteers, and agents from any claims or actions arising from injury, loss, or damage sustained while participating in activities at or associated with The Facility, including injuries resulting from negligence (excluding gross negligence or intentional misconduct under Virginia law).

3. Indemnification

The Participant agrees to indemnify The Facility LLC against any liability, damages, or costs (including attorney fees) resulting from the Participant’s actions or participation.

4. Assumption of Risk

The Participant assumes full responsibility for any injury, damage, or loss that may occur as a result of participation.

5. Medical Authorization

The Participant (or Parent/Guardian) authorizes staff to provide basic first aid, contact EMS, and permit emergency treatment until a guardian arrives. The Facility LLC is not responsible for medical costs.

6. Rules & Conduct

The Participant agrees to follow all rules, instructions, and safety guidelines; use equipment responsibly; and refrain from unsafe behavior. The Facility LLC may remove participants for unsafe conduct without refund.

7. Media Release

The Participant grants permission for The Facility LLC to use photos or videos taken during activities for promotional or educational purposes.

8. No Refund / No Guarantee

Payments for facility use, training, camps, or events are non-refundable unless stated otherwise. Participation does not guarantee skill improvement or specific outcomes.

9. Severability

If any part of this Agreement is found invalid, the remaining provisions remain in effect.

10. Governing Law

This Agreement is governed by the laws of the Commonwealth of Virginia.

11. Acknowledgment of Understanding

The Participant acknowledges reading and understanding this Agreement and signs voluntarily.
